Rubi Esparza, 33, and Basilio Tovar, 50, were both arrested and lodged into the Dallas County jail on homicide charges.

According to authorities, a couple was nabbed this month in the murder of a man discovered shot on a west Oak Cliff pavement in early November. Rubi Esparza, 33, and Basilio Tovar, 50, were processed into the Dallas County jail on one count of homicide on December 19. They were named as husband and wife in an arrest warrant affidavit, and neither of them had an attorney mentioned in court records.

Officers went to reports of a shooting in the 4300 block of West Illinois Avenue, near South Cockrell Hill Road, around 1 a.m. Nov. 5, and discovered a male with a gunshot wound to the head.
According to authorities, the man, named as 29-year-old Xavier Ramon Hernandez-Hankins, was brought to a hospital and died. Hernandez, Tovar, and Esparza were at a club earlier that night when Hernandez “became upset” and departed, according to the statement. When Tovar and Esparza couldn’t locate him outside the bar, they hopped into a black pickup truck and proceeded in search of him.

According to the statement, a witness stated that Esparza was driving that night because she hadn’t been imbibing. Tovar, who was inebriated, was a passenger, according to the statement.

The pickup drew up to Hernandez, who was strolling on the pavement, according to security footage and witness statements, before the passenger door opened and a gunshot rang out, according to the affidavit.

According to the affidavit, a license plate reader near the site of the killing identified the pickup as being registered to Esparza, and phone records also put the pair at the spot when the shooting happened.

Esparza and Tovar stayed in detention on Wednesday, with bail set at $1 million for Esparza and $250,000 for Tovar.
